Protection of Personal Data

1.1. The Buyer may purchase goods:

1.1.1. by registering in this e-shop – by entering the data requested in the registration form;

1.1.2. without registering in this e-shop.

1.2. When ordering goods, the Buyer shall specify the personal data necessary for the proper execution of the order in the relevant information fields provided by the Seller: name, surname, delivery address, telephone number, and e-mail address.

1.3. By agreeing to these Rules, the Buyer agrees that their personal data specified in clause 1.2 will be processed for the purposes of selling goods and services in the e-shop, analyzing the Seller's activities, and direct marketing.

1.4. By agreeing to the processing of their personal data for the purpose of selling goods and services in the Seller's e-shop, the Buyer also agrees that informational messages necessary to fulfill the order of goods will be sent to the e-mail address and telephone number provided by the Buyer.

1.5. When registering in the e-shop and ordering goods, the Buyer undertakes to protect and not disclose their login credentials to anyone.

 

Rights and Obligations of the Buyer

2.1. The Buyer has the right to purchase goods in the e-shop in accordance with the procedure set forth in these Rules and other information sections of this e-shop.

2.2. The Buyer has the right to withdraw from the purchase-sale contract with the e-shop by informing the Seller in writing (by e-mail at info@kotis.lt, specifying the item to be returned and its order number) no later than within 14 (fourteen) days from the date of delivery of the item, except in cases where the contract cannot be withdrawn under the laws of the Republic of Lithuania:

2.2.1. goods manufactured according to special instructions of the Buyer (custom orders), i.e., goods that are not prefabricated and are manufactured taking into account the personal choice or instruction of the Buyer, regardless of whether the production of goods has started or not, or for goods that are clearly tailored to the Buyer's personal needs;

2.2.2. perishable goods or goods with a short shelf life;

2.2.3. packaged goods that were unpacked after delivery and are unsuitable for return due to health protection or hygiene reasons;

2.3. The Buyer may exercise the right provided for in clause 2.2 only if the item has not been used, damaged, or its appearance has not substantially changed.

2.4. The Buyer undertakes to accept the ordered goods and pay the agreed price for them.

2.5. If the data provided in the Buyer's registration form changes, the Buyer must update it immediately.

2.6. The Buyer undertakes not to transfer their login data to third parties. If the Buyer loses their login credentials, they must immediately inform the Seller using the contact means specified in the "Contacts" section (by e-mail at info@kotis.lt or by phone at +37068489405).

2.7. By using the e-shop, the Buyer agrees to these Terms and Conditions of Sale and Purchase, undertakes to comply with them, and not to violate the legal acts of the Republic of Lithuania.

 

Rights and Obligations of the Seller

3.1. The Seller, Darius Bruzgulis, operating under individual activity certificate No. 1542918, undertakes to create all conditions for the Buyer to properly use the services provided by the kotis.lt e-shop.

3.2. If the Buyer attempts to damage the stability and security of the Seller's e-shop or violates their obligations, the Seller has the right to immediately and without warning limit or suspend the Buyer's ability to use the e-shop or, in exceptional cases, cancel the Buyer's registration.

3.3. The Seller undertakes to respect the Buyer's right to privacy regarding the Buyer's personal information specified in the e-shop registration form.

3.4. The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by the Buyer.

 

Purchase Rules

4.1. The Buyer may purchase goods in the kotis.lt e-shop 24 hours a day, 7 days a week.

4.2. The contract enters into force from the moment the Buyer clicks the "Confirm Order" button, and the Seller, upon receiving the order, confirms it by sending a confirmation e-mail to the e-mail address specified by the Buyer.

4.3. Prices of goods in the e-shop and in the order are indicated in Euros (EUR).

 

Purchase Conditions

5.1. The Buyer pays for the goods in one of the following ways:

5.1.1. by bank transfer – this is an advance payment where the Buyer transfers money to the e-shop's bank account;

5.1.2. using an electronic payment system, through which the Buyer undertakes to pay for the goods immediately. Only upon receipt of payment for the goods, the formation of the parcel begins and the delivery period starts to run.

 

Delivery Rules

6.1. The Seller delivers goods throughout Lithuania.

6.2. The Buyer, having chosen the delivery service at the time of ordering, undertakes to indicate the exact place of delivery of the goods, postal code, contact telephone number, and other additional information (door code, etc.).

6.3. The Buyer undertakes to accept the goods themselves. In cases where the Buyer cannot accept the goods themselves and the goods are delivered to the specified address, the Buyer has no right to submit claims to the Seller regarding the delivery of goods to an improper subject.

6.4. The Buyer undertakes to accept the goods the day after being informed of the planned delivery. If the Buyer does not accept and/or pick up the parcel, the parcel will be sent again. The Seller has the right to charge the Buyer for re-sending if additional expenses are incurred as a result.

6.5. Goods are delivered via self-service parcel terminals or by the Seller's authorized representatives (courier services). The Buyer has the opportunity to choose the delivery method when ordering goods in the kotis.lt e-shop.

6.6. The Seller delivers the goods to the Buyer in accordance with the terms specified in the product descriptions. In exceptional cases, delivery of goods may be delayed due to unforeseen circumstances beyond the Seller's control. In such a case, the Seller undertakes to immediately contact the Buyer (by phone at +37068489405 or by e-mail at info@kotis.lt) to agree on the terms of delivery. In all cases, the Seller is released from liability for violation of delivery terms if the goods are not delivered to the Buyer or are delivered late due to the Buyer's fault or due to circumstances beyond the Seller's control. 

6.7. If during delivery the Buyer notices damage to the packaging, the Buyer must note the damage on the courier's delivery document or draw up a separate act regarding packaging damage. The Buyer must do this in the presence of the courier. Failure to do so releases the Seller from liability to the Buyer for damage to goods related to packaging damage that was not noted by the Buyer in the courier's delivery document.

6.8. After the parcel has been dispatched, the Buyer cannot change the delivery address at their own discretion. If the delivery address is changed by personal consultation with the courier or another delivery service, the Seller is not responsible for compliance with the delivery deadline and has the right to require the Buyer to cover additional expenses incurred due to the Buyer's unauthorized change of the delivery address after the parcel has been sent.

 

Product Quality and Warranties

7.1. Details of goods sold in the kotis.lt e-shop are generally specified in the description of each item.

7.2. The Seller is not responsible for the fact that the goods in the e-shop may not correspond in color, shape, or other parameters to the actual size, shape, and color of the goods due to the screen settings or characteristics of the device used by the Buyer.

7.3. Goods are provided with a specific shelf life, which is indicated on the product packaging.

7.4. In cases where legal acts establish a shelf life for certain goods, the Seller undertakes to sell such goods to the Buyer in such a way that the Buyer is given a realistic opportunity to use such goods before the expiration of the shelf life.

 

Return Policy

8.1. Goods are returned in accordance with Article 6.228 (10) of the Civil Code of the Republic of Lithuania.

8.2. If the Buyer wishes to return item(s) in accordance with clause 8.1 of these Rules, the Buyer may do so within 14 (fourteen) days from the date of delivery of the goods to the Buyer by informing the Seller by e-mail at info@kotis.lt, specifying the name of the returned item, order number, and their bank account. Shipping costs for returning quality goods are covered by the Buyer.

8.3. Money is transferred to the bank account specified by the Buyer no later than within 14 days from the date of receipt of the returned item(s).

8.4. When returning goods, the Buyer must comply with the following conditions:

8.4.1. the returned item must be in its original, orderly packaging;

8.4.2. the item must not be damaged by the Buyer;

8.4.3. the item must be unused, retaining its commercial appearance (undamaged labels, unpeeled protective films, etc.) (this clause does not apply in the case of returning defective goods);

8.4.4. the returned item must be in the same complete set as received by the Buyer;

8.4.5. when returning an item, a document proving its purchase must be provided.

8.5. The Seller has the right not to accept returned goods if the Buyer fails to comply with the return procedure set forth in clause 8.4.

8.6. If the received item is incorrect and/or defective, the Seller undertakes to replace such item with an identical suitable / quality item.

8.7. In cases where the Seller does not have suitable goods for replacement, the paid amount is refunded to the Buyer, including delivery costs.

 

Responsibility of the Buyer and Seller

9.1. The Buyer is fully responsible for the accuracy of the personal data provided by them. If the Buyer fails to provide accurate personal data in the registration form, the Seller is not responsible for the consequences arising therefrom and acquires the right to claim direct damages from the Buyer.

9.2. The Buyer is responsible for actions performed using this e-shop.

9.3. A registered Buyer is responsible for transferring their login credentials to third parties. If the services provided by the e-shop are used by a third party logged into the e-shop using the Buyer's credentials, the Seller considers this person to be the Buyer.

9.4. The Seller is released from any liability in cases where losses arise because the Buyer, despite the Seller's recommendations and the Buyer's obligations, failed to familiarize themselves with these Rules, although given the opportunity to do so.

9.5. If the Seller's e-shop contains links to e-websites of other companies, institutions, organizations, or individuals, the Seller is not responsible for the information or activities carried out therein, does not maintain or control such websites, and does not represent these companies or individuals.

9.6. In the event of damage, the guilty Party shall indemnify the other Party for direct losses.

 

Marketing and Information

10.1. The Seller may, at its own discretion, initiate various promotions in the e-shop.

10.2. The Seller has the right to unilaterally change or cancel the terms of Promotions without separate notice. Any change or cancellation of Promotion conditions is valid only prospectively, i.e., from the moment it is executed.

10.3. The Seller sends all notifications to the contact means specified in the Buyer's registration form.

10.4. The Buyer sends all notifications and questions to the phone numbers (+37068489405) and e-mail addresses (info@kotis.lt) specified in the "Contacts" section of the Seller's e-shop.

10.5. The Seller is not responsible if the Buyer does not receive sent information or confirmation messages due to disruptions in internet connections or e-mail service providers' networks.

 

Final Provisions

11.1. These Terms and Conditions of Sale and Purchase of Goods are drawn up in accordance with the legal acts of the Republic of Lithuania.

11.2. All disagreements arising regarding the execution of these Rules shall be resolved through negotiations. If an agreement cannot be reached, disputes shall be settled in accordance with the procedure established by the laws of the Republic of Lithuania.
